Notice to Law Enforcement Agencies, Prosecutors, and Legal Counsel: PhantomLink operates under a strict zero-log, zero-retention technical architecture. The information below is provided to assist law enforcement and legal professionals in understanding the technical limitations of any legal process directed at this platform and to avoid unnecessary expenditure of public or private resources.
12.1 Zero-Data Response Policy. DigiMktg Co. LLC does not store, and therefore cannot produce in response to any subpoena, court order, National Security Letter, search warrant, or other legal process, any of the following: message content; sender identity or contact information; recipient identity or contact information; IP addresses associated with message creation or access events; device identifiers; geolocation data; timestamps linked to identifiable parties; or any other user-attributable data.
12.2 Technical Impossibility. The inability to comply with legal demands for user data is not a matter of policy preference or legal obstruction. It is a direct consequence of the Service's technical architecture. Data that has never been collected or has been permanently destroyed cannot be retrieved or produced. The Operator will confirm this limitation in writing upon receipt of any properly served legal process.
12.3 Third-Party Provider Data. Certain infrastructure providers engaged by the Operator — including Cloudflare, Inc. and web hosting service providers — may independently maintain technical logs pursuant to their own data retention policies. The Operator does not control these independent records. Law enforcement seeking network-level data should direct appropriate legal process to those providers directly.
12.4 Cooperation Commitment. Notwithstanding the foregoing, DigiMktg Co. LLC is a law-abiding U.S. entity and will cooperate with properly issued legal process to the full extent technically possible. Any and all information within the Operator's actual possession that is responsive to a valid legal demand will be produced. The Operator's representation that no responsive data exists constitutes a good-faith statement of technical fact, not a refusal to cooperate.
12.5 Legal Process Submission. All legal process directed at DigiMktg Co. LLC should be served to the registered agent of DigiMktg Co. LLC in the State of Illinois, with a courtesy copy to [email protected]. Informal requests, badge presentations, and non-legally-binding inquiries will be directed to the same address and evaluated on a case-by-case basis.
